Jeffrey Toobin Says Obama's Remarks on SCOTUS Decision 'Entirely Appropriate'

President Obama referred to the Supreme Court on Monday as an "unelected group of people" who would be practicing "judicial activism" if they overturned his health care law, adding that such a move would be "unprecedented."

In response, a three-judge panel on the U.S. Fifth Circuit Court of Appeals ordered the Justice Department to write a three page single-spaced letter explaining what the administration thinks about the Court and judicial review.

Toobin called the judges' action a "judicial hissy-fit" and "totally inappropriate," while insisting that what President Obama said was "entirely appropriate."
