Le Pen Could Face Three Years in Prison for Tweeting Photo of ISIS Beheading

The French National Assembly voted to strip National Front leader Marine Le Pen’s parliamentary immunity on Wednesday, leaving her open to prosecution for images she posted in 2015.

France 24 reports that in 2015, Le Pen posted a photo of ISIS beheading American journalist James Foley with the caption, “Daesh is THIS!” Le Pen later deleted the image following outrage from Foley’s family.

However, because of the French parliament’s vote, Le Pen can face up to three years in prison for tweeting that image due to ban on “publishing violent images.”

The BBC explains that when Le Pen tweeted the image, she was a member of European Parliament. The European Parliament, in March, lifted her immunity. But when Le Pen became a member of the French parliament in June, she was granted immunity again.

Le Pen addressed her loss of immunity on Twitter, writing [translation provided by Google], “It is better to be a jihadist who returns from Syria than a member of parliament who denounces the abjections of the Islamic State: we take less judicial risks.”

During the French presidential election, Le Pen won 33.9 percent of the vote compared to Emmanuel Macron’s 66.1 percent.
