Dems Bash Gorsuch Rulings for Favoring Law Over Identity Politics

Democrats were quick to attack Supreme Court nominee Neil Gorsuch – based on WHO he ruled for, NOT on whether the ruling was legally justified.

The opposition to Gorsuch voiced by Democrats is based on identity politics and ideology, not the rule of law, so they criticize him for being the wrong type of ideologue. Basically, they simply don’t like the people or organizations Gorsuch ruled for or represented, regardless of whether or not they were in the right.

Notice that they don’t take issue with the legal merit of any ruling; they just complain about who won and who lost. They argue that corporations and religious values should be presumed guilty, while liberal causes (abortion, unions, government power) are, by definition, always righteous.

“As an attorney, Judge Gorsuch routinely represented big businesses in class action lawsuits. As a judge on the Tenth Circuit, he wrote a concurring opinion in Hobby Lobby v. Sebelius -- the case that allowed employers to deny basic health care coverage to women by ruling the Affordable Care Act's contraceptive mandate was unconstitutional.

He upheld a decision that denied long-term insurance benefits to a worker who sustained a work-related injury that required spinal surgery.”

“President Trump intends to place someone hostile to women’s rights on the Supreme Court.  In the Hobby Lobby case, Judge Neil Gorsuch revealed his eagerness to single out women’s health for discrimination and enable employers to meddle in their workers’ most intimate health decisions.” - Statement

“[Trump] appointed someone who has come down on the side of corporate America versus class action suits, on securities fraud, he's come down against employees' rights, clean air, clean water, food safety, safety in medicine and the rest.”

“What saddens me the most as a mom and a grandmother, though, is his hostility towards children in school, children with autism. He has ruled that they don't have the same rights under the IDEA (the Individuals with Disabilities Education Act) that children -- that they could reach their intellectual and social advancement under the law. He has said that doesn't apply to them. He's come down against them under the ADA, as well, and again under IDEA. - CNN

Sen. Sherrod Brown (D-Ohio):

“I cannot support any nominee who does not recognize that corporations are not people. The Supreme Court has enormous influence over the lives of everyday Ohioans, and any nominee must be willing to defend their rights to make their own healthcare decisions, collectively bargain for safe workplaces and fair pay, and to be protected from discrimination and Wall Street greed."

“Gorsuch’s record includes:

  • Ruling that corporations are people;
  • Ruling against women’s rights to basic healthcare at places like Planned Parenthood
  • Arguing against the rights of working Americans to band together to hold Wall Street and corporations accountable for abuses;
  • Hostility toward anti-discrimination and criminal justice protections, including opposition to equal protection for LGBTQ Americans; and
  • Judicial theories that oppose protections that ensure clean air and water and safe food and medicine.” - Statement

Sen. Chuck Schumer (D-NY):

“Judge Gorsuch has repeatedly sided with corporations over working people, demonstrated a hostility toward women’s rights, and most troubling, hewed to an ideological approach to jurisprudence that makes me skeptical that he can be a strong, independent Justice on the Court." – The Hill

Sen. Elizabeth Warren (D-Mass.):

“Before even joining the bench, he advocated to make it easier for public companies to defraud investors. As a judge, he has twisted himself into a pretzel to make sure the rules favor giant companies over workers and individual Americans. He has sided with employers who deny wages, improperly fire workers, or retaliate against whistleblowers for misconduct. He has ruled against workers in all manner of discrimination cases. And he has demonstrated hostility toward women’s access to basic health care.” – Facebook
