Sen. Ted Cruz (R-TX) claims Sen. Elizabeth Warren’s (D-MA) question regarding the credibility of Justice John Roberts helped deliver the votes to defeat the impeachment of the president.

“Elizabeth Warren helped defeat the impeachment of the President of the United States,” Cruz said Friday on his podcast The Verdict.

Warren posed a question during the impeachment hearings last week, asking if Roberts presiding over the impeachment trial where the Senate has not allowed Democratic witnesses has “contributed to the loss of legitimacy of the Chief Justice, The Supreme Court and the Constitution.”

“That little stunt she pulled was a campaign stunt. That was a fundraising stunt, that was designed to thrill the left wing activists in the Iowa caucuses," Cruz said.

“That stunt helped deliver the votes of Lisa (Murkowski) and Lamar (Alexander).”

“Because it made clear, this a political game and if John Roberts doesn’t vote the way Elizabeth Warren wants she’s going to call him a political hack and throw him into politics. And it suddenly raised the price of their voting and making it 50/50 because you don’t want to see the court thrown into that political swamp," Cruz added.

If there was a 50-50 tie vote in the Senate, Roberts would have been under pressure to cast a tie-breaking vote.  Although, Roberts made it clear he would have declined to vote on the issue.
