Democratic Senator and 2020 presidential candidate Kirsten Gillibrand publicly stated she supports adding a third-gender classification at the federal level for people who identify as neither male nor female.

According to CBS, Gillibrand “emphatically said ‘yes’” when asked by a transgender person during an LGBTQ event Friday whether she supports the federal government adding a third category for “non-binary” residents, which would allow them to register as “X” instead of male or female on legal documents like drivers licenses and birth certificates.

Some states, including Oregon, Washington State, Maine and California, along with cities like Washington, D.C. and New York City, already provide their own form of a third gender option for “non-binary” persons, a confusing system critics say could create major problems for law enforcement officers, medical personnel and the justice system.
