Krauthammer: ‘SCOTUScare is Here to Stay’ Unless GOP Takes White House

“SCOTUScare is here to stay, unless and until the Republicans win the White House and hold the Senate,” political commentator Charles Krauthammer said on Fox News Thursday night.

“If they do, there is no question that they are going to repeal and replace.”

His remarks followed Thursday’s King v. Burwell Supreme Court decision in favor of President Obama’s healthcare law.

With a ruling of 6-3, the Court upheld tax credit subsidies brought through federal exchanges established by Obamacare.

In his dissenting opinion, Judge Scalia explains why the law contravenes the Constitution: 

In order to receive any money under §36B, an individual must enroll in an insurance plan through an 'Exchange established by the State.'

"The Secretary of Health and Human Services is not a State. So an Exchange established by the Secretary is not an Exchange established by the State — which means people who buy health insurance through such an Exchange get no money under §36B.

"Words no longer have meaning if an Exchange that is not established by a State is 'established by the State.'"

Krauthammer warned that, if the Democrats hold the White House come 2016, the Patient Protection and Affordable Care Act will remain.

“If the Democrats hold the White House, it’s here to stay,” he said.
