Former Atlanta police officer Garrett Rolfe filed a lawsuit Tuesday in Fulton County Superior Court after being fired one day after fatally shooting Rayshard Brooks on June 12.

According to the Associated Press (AP):

Garrett Rolfe was fired June 13, the day after he fatally shot Brooks outside a Wendy’s restaurant in Atlanta. In a lawsuit filed Tuesday in Fulton County Superior Court, he says he was fired “without an investigation, without proper notice, without a disciplinary hearing, and in direct violation of the municipal code of the City of Atlanta.”

Rolfe’s lawsuit targets Atlanta Mayor Keisha Lance Bottoms and interim Atlanta Police Chief Rodney Bryant.

Former police chief Erika Shields resigned the same day she fired Rolfe on June 13.

Rolfe was one of two officers, the other was since-reassigned officer Devin Brosnan, who responded to the June 12 call in which Brooks was allegedly sleeping in a Wendy’s drive-thru. Brooks got into a physical altercation with Brosnan and Rolfe, eventually taking Brosnan’s taser and running away before turning and pointing the taser at the officers. That was when Rolfe fired his weapon resulting in Brooks’ death.

Rolfe has been charged with felony murder, along with 10 other charges brought by Fulton County District Attorney Paul Howard. The charges were filed against Rolfe just five days after the incident.
