Biden-Harris Admin. ‘Weaponizing’ Judges, DOJ to Protect Illegal Aliens, Judiciary Cmte. Report Warns

A new report by the House Judiciary Committee documents how the Biden-Harris Administration has used the nation’s immigration courts to advance an open-borders agenda.

“The Biden-Harris Administration has used the backlog [of cases] as an excuse to allow even more aliens to remain in America,” the committee explains in a press release announcing the report:

“Instead of adjudicating cases based on the merits of their claims—such as valid asylum requests—immigration judges have rubberstamped dismissals, terminations, and closures.”

The report details how the Biden-Harris administration has employed “administrative maneuvering at both the Justice Department and DHS” to advance its open-borders agenda. As a result:

  • Nearly one million illegal aliens can remain in the United States without the possibility of deportation.
  • More than 700,000 illegal aliens have had their cases dismissed, terminated, or administratively closed, allowing them to stay in the country indefinitely without facing immigration consequences.
  • 109,568 asylum cases were non-adjudicated through the first nine months of Fiscal Year 2024 – more than the 109,089 cases “not adjudicated” in all of the previous year and far above the 12,960 cases not adjudicated in Fiscal Years 2017-20 combined.
  • The Department of Homeland Security (DHS) failed to file the necessary documentation to begin immigration court removal proceedings in roughly 200,000 additional cases.

 

By “weaponizing both immigration judges within the Justice Department and ICE attorneys within DHS,” the Biden-Harris administration has “systematically remade America’s immigration courts in the image of open-borders extremism,” the report says.

And, by gaming the system to allow illegal aliens to remain in the U.S., the Biden-Harris is encouraging even more illegal immigration, thus exacerbating the current border crisis, the report warns:

“This quiet amnesty not only undermines U.S. immigration law but also incentivizes additional illegal aliens to arrive at America’s borders, knowing they will be released into the country and never deported.”
