A Republican candidate for California state governor is calling for the arrest and federal indictment of California state attorney general Xavier Becerra for threatening to prosecute employers who comply with federal immigration law.

Assemblyman Travis Allen (R-Huntington Beach) in a Monday night interview on Fox News said that Xavier is “criminally trying to obstruct justice” by threatening to prosecute law-abiding business owners under a new state law.

The new state law, The Immigration Worker Protection Act, bars California employers from assisting federal immigration authorities, including providing agents with employee records or consent to access the workplace.

The law, sponsored by Becerra and State Assemblyman David Chiu (D-San Francisco), intends to prevent illegal immigrants from being detained at workplaces. The legislation was signed by Democratic Gov. Jerry Brown last year and took effect Jan. 1.

Violators could face fines of up to $10,000.

California also passed a new law also effective Jan. 1 known as the SB 54 that prohibits state and local law enforcement agencies, including school police and security departments, from using resources for immigration enforcement purposes.

The two laws effectively make California a “sanctuary state.”

Becerra warned in a press conference on Thursday that if employers "voluntarily start giving up information about their employees or access to their employees in ways that contradict our new California laws, they subject themselves to actions by my office," the Sacramento Bee reported.

"This goes far beyond just legislators trying to make California a sanctuary state," said assemblyman and gubernatorial hopeful Allen.

“He's crossed the line,” he went on. “This is now a criminal offense. The Department of Justice needs to come ... literally arrest, indict Xavier Becerra for breaking federal law.”

The California gubernatorial election to succeed Gov. Brown will be held on Nov. 6. Brown is ineligible to run for re-election for a fifth term due to term limits.
