Biological Boy Beat Girls In Track Events Over 700 Times, Legal Filing Says

If anyone’s still dumb enough to claim that transgender “women” - i.e., biological males - winning sports competitions against girls at an alarmingly high rate (looking at you, AOC), show them this. Because they’re wrong.

According to a new court filing from the the Alliance Defending Freedom, one biological boy in West Virginia defeated his female competitors in girls' track events more than 700 times, robbing young ladies of their accomplishments and setting a new, unattainable standard for female athletes. While the motion does not name the student, it's likely the firm is referring to 13-year-old Becky Pepper-Jackson, a boy who identifies as a girl who sued the state of West Virginia over a new law that would have mandated students use facilities and participate on sports teams according to their biological gender. Pepper-Jackson won his case in a Richmond-based federal appeals court, and has continued to compete at girls' track events - even as the young ladies he's competing against are punished for respectfully declining to participate.

The ADF’s filing comes in response to the Biden administration’s amending of Title IX, a federal civil rights rule that now includes “gender identity and expression” to protections against sex-based discrimination.

"The Biden administration’s radical redefinition of sex will upend the equal opportunities that women and girls have enjoyed for 50 years under Title IX and will threaten their safety and privacy at every level," ADF senior counsel Rachel Rouleau said in a statement accompanying the firm’s motion asking the 6th Circuit Court of Appeals to stop the Biden administration’s new rule from going into effect on August 1.

While Title IX was originally put in place in 1972 to ensure schools and other tax-funded institutions couldn’t discriminate against women, the new rule would mandate that public schools and universities that receive taxpayer funding must allow student athletes to compete on sports teams that match their “gender identity,” regardless of their biology and the advantages that come with it. The rule also mandates students be allowed to use whatever bathroom and changing facilities match their “identity,” allowing biological boys access to restrooms and locker rooms with girls. In addition to schools, the Title IX changes also apply to tax-funded facilities like shelters and prisons, giving biological men access to women-only areas among some of the most vulnerable populations.

The ADF says the change will fundamentally undermine women’s access to equal opportunities, particularly for women and girls in sports.

“On April 29, unelected Department of Education officials published Title IX rules that add the concept of gender identity – 'an individual’s sense of their gender.' The new rules sometimes even prioritize this subjective concept over someone’s objective sex, requiring schools to allow some men to use women’s restrooms, to change in women’s locker rooms, to shower in women’s showers, and to compete in women’s sports," their motion states.  "The result is that Title IX’s primary beneficiaries are denied the privacy, dignity, equality, and fairness needed to benefit from our educational system.”
